Statutory bans can be repealed through a single piece of legislation. Constitutional bans are more difficult to repeal and often require voter approval, and they could invalidate statutes allowing same-sex marriage.

Prohibited or likely prohibited (32) Performing same-sex marriages would not be allowed. The Respect for Marriage Act would require recognition of same-sex marriages performed in other states and would recognize the marriage federally.
Allowed or likely allowed (19) Performing same-sex marriages would be allowed. The Respect for Marriage Act would provide protection for same-sex couples if they traveled or moved to states that prohibit it and would recognize the marriage federally.

Pre-Obergefell laws prohibiting same-sex marriage would be enforceable if the decision is reversed
